Capitect, Inc. is committed to protecting your privacy. Keeping your information secure and confidential is a critical part of our business.

This Privacy Policy (“Policy”) explains how Capitect, Inc. (“we” or “us”) collects, utilizes, discloses, and secures personally identifiable information (“Information”) from our users in connection with the website located at https://www.capitect.com and any additional subdomains of capitect.com (collectively, the “Site”). All Site visitors and users, including financial advisors (“Advisors”) and their clients (“Clients”) are collectively referred to as “you.”

Please read and make sure you understand this Policy. We may modify this Policy in the future, so please check back regularly for updates. We reserve the right to make revisions at any time and the revisions will be effective upon our posting updates to this website. If you access the Site after a revision is posted, your use will constitute acceptance of the revision.

Information We Collect

This Policy applies to Information we collect from you, but does not apply to any services or products offered by third parties and made available to you through our Site. We obtain Information in the following forms: (i) Information provided by you as part of registration, (ii) Information collected from certain third parties, and (iii) Information that is obtained from your use of the Site.

(i) Information provided by you: you may be required to register in order to access certain features of the Site. As a registered user, you may be asked to provide the following information:

  • Initial registration information to create your personal account such as your name, login name and password, email address, occupation, gender, and other demographic information.
  • Advisors may be required to provide billing and payment information and the names of Clients to be authorized to use the Site.
  • Third-party credentials you may choose to provide to us, which may include certain passwords, usernames, account numbers, and other account information for third party sites and Internet services.
  • Financial information you may provide on the Site.

(ii) Information from Third-Parties: if you register certain third party accounts (such as a bank account) through the Site, we may collect on your behalf certain Information from such accounts in order to display information to you on the Site. We do not store any third-party account credentials when you link to third party accounts through the Site.

(iii) Information from your use of the Site: we may automatically collect certain Information from your use of the Site, such as usage data, preferences, or any other data that includes Information concerning how you use the Site. In particular, we may collect the following types of Information:

  • Your browser type, language, plug-ins, Internet domain and operating system; your Internet Protocol (IP) address;
  • The website(s) You visited before visiting the Site and the website(s) you visited after visiting the Site;
  • Unique identifiers, including mobile device identification numbers, that may identify the physical location of such devices;
  • Data collected through cookies and other tracking technologies, such as your browser type, time spent on our web sites and which of our pages you visited, and statistical information about Site usage; and
  • Data related to your interactions with content on the Site, such as the type of content viewed on the Site.

How We Use Your Information

We use Information collected from your use of the Site specifically to: (i) analyze, operate and improve the Site and services offered thereon; (ii) customize the content you see when you use the Site; (iii) provide customer support; (iv) enforce this Agreement; (v) conduct market analysis, traffic flow analysis and related reporting to third parties; and (vi) for any other purposes disclosed to you at the time we collect your Information.

When We May Share Your Information

We may share certain Information with third party vendors who supply software applications, web hosting, analytics, and other technologies for the Site. Those third parties will never use such Information for any other purpose except to provide services in connection with the Site. When we include your data as part of our trends and analysis information and reports, we always remove all personally identifiable information from that data first, so your Information is aggregated with others and anonymized.

We use certain third party service providers to help us measure the performance of our online promotions or analyze Site activity. We may permit these service providers to use cookies and similar technologies to perform these services. We do not share any financial information about our customers with these third party service providers, and these service providers do not collect such information on our behalf. We may send certain vendors your Information to analyze how users use our site and we may aggregate such data for analytics purposes. For example, we may send your name, email, user type, sign-up date, and activity using our Site to be analyzed in order to improve the Site. We use Google Analytics on parts of the Site to collect information about Site usage such as how often visitors visit the site and which pages they view in order to learn how to better serve our customers. You can opt out of Google Analytics by following the instructions on the Google Analytics opt-out page.

We NEVER rent, sell, or disclose your information to third parties for their marketing purposes. We will not share or sell any of your Information to any third party except as otherwise stated in this Policy and in the following circumstances: (a) in response to subpoenas, court orders or legal process, to the extent permitted and as restricted by law; (b) when disclosure is required to maintain the security and integrity of the Site, or to protect any user’s security or the security of other persons, consistent with applicable laws; (c) when disclosure is directed or consented to by the user who has input the Information; (d) in the event that we go through a business transition, such as a merger, divestiture, acquisition, liquidation or sale of all or a portion of its assets, Your Information will, in most instances, be part of the assets transferred; or (e) in limited circumstances, we may disclose Your email address in order to comply with laws and regulations, including the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act of 2003).

How We Secure Your Information

Information provided by you is protected by the login and password you create when registering to use the Site. Please understand that you can help prevent the unauthorized disclosure of Information by choosing and protecting your password appropriately. You can also help prevent unauthorized disclosure by not sharing your password and preventing others from using your computer or mobile device.

We do not store your account credentials, as we work with a third party account aggregation vendor in order to process your account credentials to use the Site. Only usernames are stored in our system in order to prevent linking duplicate accounts, and such usernames are one-way encrypted. We also use a secure third party payment gateway to store payment information, and we do not store your credit card information on our systems.

We use encryption technology and other administrative security measures to protect all collected Information. Please understand that no security system is perfect and, as such, we do not guarantee the security of the Site, or that your Information won’t be intercepted while being transmitted to us. If we learn of a security systems breach, then we may post a notice, or attempt to notify you by email and will take reasonable steps to remedy the breach.

Reviewing and Updating your Information

You can view and update the profile and account information we collect for you by going to the “account settings” function on the Site. The credibility and relevance of our services depend on your providing us with complete, accurate and up-to-date information about yourself and your accounts, both now and in the future.

Third Party Links

Although the Site may contain links to third party websites, we are not responsible for the privacy policies and/or practices on those third party websites. Where we have linked to a third party website, you should read the privacy policy stated on that third party website.

Advertising

We do not allow third party advertising on our web site or applications.

Social Media

The Site may integrate authentication or social experiences on social media platforms such as Facebook®, Twitter®, Google Circles and LinkedIn® that enable login or online sharing and collaboration among users who have registered to use such social media platforms. Any content you post, such as pictures, information, opinions, or any Information that you make available to other participants on these social platforms, is subject to the terms of use and privacy policies of those platforms. Please refer to the privacy policies of these third-parties to better understand your rights and obligations with regard to such content.

Your Choices

When we communicate our own marketing offers to you, these communications are CAN-SPAM compliant, including the ability for you to opt-out of marketing communications. Please note that certain services-related messages that we send you are necessary for proper use of the Site and you may not have the ability to opt out of those messages.

We use cookies and other similar technologies to enable us to personalize the site for you. The cookies we use are for collecting information such as your browser type, time spent on our web sites and which of our pages you visited. We do not use cookies to capture personal information.
